El artículo muestra cómo en el pensamiento feminista español la oposición teórica fundamental no se produce en torno al debate igualdad/diferencia, sino entre aquellos/as que entienden que la igualdad significa la incorporación a las formas de vida existentes, y aquellas/os que consideran que la igualdad, para realizarse, implica un cambio social más profundo relacionado con los valores. Se puede pensar en la subordinación de las mujeres desde dos perspectivas: la subordinación es consecuencia de que las mujeres no han accedido a (...) las posiciones sociales ocupadas por los hombres en la vida pública, y se puede pensar que la subordinación es consecuencia de una particular sujeción de las mujeres, una particular inclusión en el mundo (incluidas a partir de lo privado, la familia, la sexualidad...). De ahí dos formas de luchar contra la subordinación: incorporándose a lo público y criticar la exclusión. Estos dos modelos han sido utilizados de forma complementaria por el pensamiento feminista en España. (shrink)

El objetivo de este artículo es aportar elementos para construir una compresión de las menores en el sistema de justicia penal que atienda a las discriminaciones específ icas de las que son objeto y que tenga en cuenta los elementos particulares que se dan con relación a las infractoras más jóvenes. En la primera parte del artículo, se indica como la historia ha invisibilizado a las niñas y sus experiencias. El análisis histórico evidencia cómo el control ha constituido un elemento (...) clave en la construcción y percepción de la identidad femenina, particularmente a través de los procesos de socialización de las niñas, cargados de estereotipos y expectativas de lo que se espera de una buena mujer. La segunda parte muestra como la identidad de género atraviesa el sistema de justicia juvenil, que reprodu- ce y amplif ica los sexismos y discriminaciones que las niñas sufren en otros ámbitos. Y por último, se exponen los principales aportes de la criminología feminista, con el fin de comprender la experiencia de las menores en la justicia juvenil. (shrink)

El objetivo de este artículo es mostrar que para comprender adecuadamente la violencia de género debemos tomar muy seriamente que dicha violencia de género se nutre también de violencias institucionales, de acciones u omisiones realizadas por el Estado y sus autoridades. En la primera parte del artículo se indica de qué manera los instrumentos internacionales han desarrollado el concepto de violencias institucionales en el ámbito de la violencia contra las mujeres y cómo dicha violencia institucional puede tomar diferentes formas. En (...) la segunda parte del texto, se utilizan dos investigaciones empíricas para mos- trar qué prácticas de violencias institucionales se estarían dando en la aplicación de la ley 1/2004, de medidas de protección integral contra la violencia de género. Se destaca cómo el tratamiento judicial del fenómeno, traspasado por prácticas androcéntricas y estereotipos de género, produce resultados que pueden ser entendidos como violencia institucional: baja tasa de condenas, estereotipos discriminantes en la conceptualización de la violencia de género y atención revictimizante a las mujeres. Para f inalizar, se exponen, partiendo de las propias mujeres, algunas de las experiencias de violencias institucionales en el ámbito del tratamiento penal de la violencia de género. (shrink)

This article challenges the assumption underlying most education reforms that constructivism is politically neutral and intrinsically democratic. It makes this argument by examining the curriculum reform in Spain during the 1980s and 1990s in light of the neoliberal politics that the country was experiencing at that time. This study employs the poststructuralist analytical lens of governmentality developed by Foucauldian scholars. Accordingly, it claims that, the psychological version of constructivism adopted by the official curriculum reform failed to deliver promises for democracy (...) because it was crafted within the same neoliberal political rationality that redefined the terms of government in the late 1980s, a redefinition that decontextualized the learner from his/her social context and adopted the logic of the market. Within the framework of an interdisciplinary project on epistemic strategies in text and talk, this article examines such strategies in a secondary school textbook on social science. After a summary of current insights into the theory of knowledge in philosophy, psychology and linguistics, it is shown how discourse presupposes and expresses knowledge, with special emphasis on discourse processing and learning from text and its applications in education. The specific aim of this article is to study in some detail how exactly (...) ‘new’ knowledge is formulated in pedagogical discourse, and how ‘old’ knowledge is presupposed in a lesson on migration. We thus are able to describe the categories of, and the functional relations between, old and new knowledge, as discursive manifestations of underlying cognitive strategies of teaching and learning. It was also observed that in textbooks what is purported to be presented as knowledge often has an ideological basis. (shrink)

This study investigates the effects on organization’s financial performances of, first, the extent to which the organizations are involved in controversial business activities, and second, their level of social performance. These companies can be considered non-socially responsible given the harmful nature of the activities they are involved in. Managers of these companies may still have incentives to pursue socially responsible actions if they believe that engaging on those actions will help them to achieve legitimacy and improve investors’ perception about them. (...) We develop a comprehensive methodology to investigate these corporate social performance (CSP)-related effects in a complex but specific setting. To this end, we analyze a sample of 202 US firms for the period 2005–2008 using a novel method in this area: partial least squares. Our results indicate that, contrary to the general findings in prior literature, companies involved in controversial business activities which engage in CSP do not directly reduce the negative perception that stakeholders have about them. Instead, we found evidence of a positive mediation effect of CSP on financial market-based performance through innovation. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

The relation between Wittgenstein's philosophy of mathematics and mathematical Intuitionism has raised a considerable debate. My attempt is to analyse if there is a commitment in Wittgenstein to themes characteristic of the intuitionist movement in Mathematics and if that commitment is one important strain that runs through his Remarks on the foundations of mathematics. The intuitionistic themes to analyse in his philosophy of mathematics are: firstly, his attacks on the unrestricted use of the Law of Excluded Middle; secondly, his distrust (...) of non-constructive proofs; and thirdly, his impatience with the idea that mathematics stands in need of a foundation. These elements are Fogelin's starting point for the systematic reconstruction of Wittgenstein's conception of mathematics. (shrink)

Este artículo trata de la teoría de la percepción en el De Sensibus de Teofrasto y en el De Rerum Natura de Lucrecio. Teofrasto realiza una exposición de las opiniones de Empédocles, Clidemo, Diógenes de Apolonia, Demócrito, Anaxágoras y Platón; pero también realiza una amplia crítica de las opiniones de dichos autores. Por otra parte, el poema de Lucrecio, en su libro cuarto, expone la teoría de los simulacra (D. R. In the present paper we address the problem of optical isomerism embodied in the socalled “Hund’s paradox”, which points to the difficulty to account for chirality by means of quantum mechanics. In particular, we explain the answer to the problem proposed by the theory of decoherence. The purpose of this article is to challenge this answer on the basis of a conceptual analysis of the phenomenon of decoherence, that reveals the limitations of the theory of decoherence to solve the difficulties (...) posed by optical isomerism and, in general, by quantum measurement. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. El presente artículo pretende analizar los efectos transformadores que la pandemia por Covid-19 ha obrado en nuestras existencias individuales y en nuestra convivencia social cotidiana desde la propuesta analítica del filósofo surcoreano Byung Chul-Han. Dicha transformación es de tal profundidad que, para nuestro autor, viene a exacerbar los males de la sociedad contemporánea, como el agotamiento y el cansancio por autoexplotación y permanente optimización de sí mismo propiciados por el neoliberalismo globalizado y omnipresente en Occidente. Desde esta constatación analizaremos en (...) particular cómo la prevalencia de la comunicación digital obligada por la emergencia viral trae consecuencias antropológicas que amenazan con eliminar lo esencial de la vida humana: la construcción de rituales, la estructura temporal cotidiana, el contacto corporal con los demás, la pertenencia a una comunidad y la apreciación de lo real en su genuina dimensión ontológica. Finalmente, exploraremos una posible salida a la alienación virtual en que forzadamente se encuentra la sociedad contemporánea. (shrink)

This article aims to clarify facts and contribute reasons that could lead one to consider the possibility of the existence of natural dispositions which, in that case, should be considered as ethical precursors. Given that the neuroethics proposal focuses attention and studies on the human brain in order to carry out the search of those natural dispositions, this text suggest an initial question: is it possible to go beyond the brain in that search? Or even better, before it? In this (...) regard, Baruch Spinoza proposes lines of reflection in his Ethics which appear susceptible to be taken into account and that, interestingly, connect with the recent works of the neuroscientist Antonio Damasio. Banking firms are becoming increasingly aware that their clients’ management of environmental and social risks may in term threaten their own business as lenders and investors. In addition, stakeholders are requiring banks to improve their social performance. As a result, some banks are developing corporate social responsibility (CSR) policies and management systems to reduce potential risks and improve their performance. In the Spanish financial system, half of the banking firms are savings banks, most of which have always used some Corporate (...) Social Responsibility (CSR) criteria in their management. Private Banks have only recently started to integrate social aspects in their performance. However, no formal analysis has been carried out on the impact of CSR strategies. Various initiatives have been launched nationally and internationally to include the social dimension in management systems. The purpose of this research is to analyse the social performance of the main Spanish financial companies through public data such as social or sustainability reports and media sources. In order to do this, we need to determine which CSR criteria most greatly affect banking firms and to choose the most accurate quantitative and qualitative indicators to measure social performance. Francez has suggested that connexivity can be predicated of connectives other than the conditional, in particular conjunction and disjunction. Since connexivity is not any connection between antecedents and consequents—there might be other connections among them, such as relevance—, my question here is whether Francez’s conjunction and disjunction can properly be called ‘connexive’. I analyze three ways in which those connectives may somehow inherit connexivity from the conditional by standing in certain relations to it. I will show that Francez’s connectives fail (...) all these three ways, and that even other connectives obtained by following more closely Wansing’s method to get a connexive conditional, fail to be connexive as well. Hans Jonas apuesta a favor de la libertad de nuestras acciones como principal eje con el que nos relacionamos responsablemente con el mundo. En el siguiente artículo discutiremos sobre el poder y el deber humano bajo la lupa de la responsabilidad, y en definitiva, sobre la revalorización ontológica de la Naturaleza (...) y la preservación del ser en este nuevo horizonte ético que fundamenta Jonas como el nuevo corazón de la ética del futuro. Algunas de las preguntas clave serán: ¿qué ocurre con el pronóstico de las consecuencias de una acción para la humanidad y para con la Naturaleza? ¿qué es y de qué forma hablamos de la responsabilidad? ¿cuántos errores y pruebas podemos permitirnos en una cadena de eventos tecnológicos donde está en juego el futuro de la humanidad y su dignidad como condición imprescindible? El presente ensayo busca, principalmente, acceder de modo crítico a la interrogante de si acaso los contenidos de las experiencias perceptuales son estructurados y compuestos por conceptos de un modo análogo a actitudes proposicionales como la creencia y el deseo; para así establecer y transparentar dos argumentos –la importancia del factor contextual y la condición de re-identificación– que se constituyen, en cierta medida, como un obstáculo para la postura conceptualista. Ambos argumentos suponen una problemática a la visión que enfatiza que (...) en todos los casos el contenido de una experiencia perceptual contiene necesariamente conceptos que especifican a cabalidad cada uno de los elementos disponibles a nivel consciente durante dicha experiencia al mismo tiempo, es decir, la visión que asevera que el contenido de las experiencias perceptuales es irremediablemente conceptual, y que estos conceptos son capaces de detallar y especificar las propiedades y los objetos dispuestos en la experiencia perceptual. Aim: The presence of noise in urban environments is rarely considered a factor that causes damage to the environment. The primary generating source is transportation means, with vehicles being the ones that affect cities the most. Traffic noise has a particular influence on the quality of life of those who are exposed to it and can cause health alterations ranging from annoyance to cardiovascular diseases. This study aims to describe the relationship between the traffic noise level and the perceived annoyance (...) in the inhabitants of a city on the Northern Border of Mexico. The work carried out in a city represents the vulnerability characteristics: economic, social, and migratory of its sizable portion of the inhabitants. Due to that, it is impossible to identify precisely the number of residents as the number of vehicles in circulation.Methods: The streets and avenues with an annual average daily traffic of more than 1,000 vehicles were considered for the measurement of traffic noise. The equipment used was a vehicle gauge with non-invasive speed radar; type I integrating sound level meters, with their respective gauges and tripods. A questionnaire was applied to people living within 250 m of the streets and avenues in which the noise was measured.Results: The noise measurement found a parameter of LAeq estimated for 12 h during the day, exceeding 70 dBA. The data received from the questionnaire were statistically tested by using Pearson's correlation tests. A total number of 2,350 people were participated, of whom 1,378 were women and 972 were men. The age of participants is ranged from 18 to 75 years. The overall perception of traffic noise annoyance identified that 1,131 participants responded “Yes” as they considered the noise annoying. Participants who responded “No” as well as those who responded “Do not know” resulted in a total of 1,219 people.Conclusion: The results show that the population is desensitized to traffic noise and does not perceive it as an annoyance. The flow of vehicles and the type of vehicles are the significant factors for the propagation and increase in the traffic noise levels. Women present a considerable appreciation of traffic noise perception instead of younger people who demonstrate a higher tolerance to high-level exposure. This reflects the lack of information of the population around the noise problem and its effects. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. In this paper we discuss whether the relation between formulas in the relating model can be directly introduced into the language of relating logic, and present some stances on that problem. Other questions in the vicinity, such as what kind of functor would be the incorporated relation, or whether the direct incorporation of the relation into the language of relating logic is really needed, will also be addressed.

Se analiza el concepto de superstición de Spinoza como dispositivo político de alteración de la lógica afectiva y, por ende, del deseo, instituyendo determinadas formas de acción y pensamiento. En virtud de lo anterior, se propone una lectura sobre su devenir conceptual, considerando las nociones de fetichismo en Marx, religión capitalista en Benjamin, espectáculo en Debord y discurso moral en Coccia, de esta manera se pone en evidencia la actualidad del funcionamiento de la superstición en la época del capitalismo.

Teleosemantic theories aspire to develop a naturalistic account of intentional agency and thought by appeal to biological teleology. In particular, most versions of teleosemantics study the emergence of intentionality in terms of biological purposes introduced by Darwinian evolution. The aim of this paper is to argue that the sorts of biological purposes identified by these evolutionary approaches do not allow for a satisfactory account of intentionality. More precisely, I claim that such biological purposes should be attributed to reproductive chains or (...) lineages, rather than to individual traits or organisms, whereas the purposes underlying intentional agency and thought are typically attributed to individuals. In the last part of the paper I suggest that related difficulties are also faced, despite appearances, by accounts of intentionality relying on alternative organizational approaches to biological teleology. A contra-classical logic is a logic that, over the same language as that of classical logic, validates arguments that are not classically valid. In this paper I investigate whether there is a single, non-trivial logic that exhibits many features of already known contra-classical logics. I show that Mortensen’s three-valued connexive logic _M3V_ is one such logic and, furthermore, that following the example in building _M3V_, that is, putting a suitable conditional on top of the \(\{\sim, \wedge, \vee \}\) -fragment of (...) _LP_, one can get a logic exhibiting even more contra-classical features. This paper outlines a procedure for assessing the quality of failure explanations in engineering failure analysis. The procedure structures the information contained in explanations such that it enables to find weak points, to compare competing explanations, and to provide redesign recommendations. These features make the procedure a good asset for critical reflection on some areas of the engineering practice of failure analysis and redesign. The procedure structures relevant information contained in an explanation by means of structural equations so as to (...) make the relations between key elements more salient. Once structured, the information is examined on its potential to track counterfactual dependencies by offering answers to relevant what-if-things-had-been-different questions. This criterion for explanatory goodness derives from the philosophy of science literature on scientific explanation. The procedure is illustrated by applying it to two case studies, one on Failure Analysis in Mechanical Engineering (a broken vehicle shaft) and one on Failure Analysis in Civil Engineering (a collapse in a convention center). The procedure offers failure analysts a practical tool for critical reflection on some areas of their practice while offering a deeper understanding of the workings of failure analysis (framing it as an explanatory practice). It, therefore, allows to improve certain aspects of the explanatory practices of failure analysis and redesign, but it also offers a theoretical perspective that can clarify important features of these practices. Given the programmatic nature of the procedure and its object (assessing and refining explanations), it extends work on the domain of computational argumentation. (shrink)

Coherentists fail to distinguish between the individual revision of a conviction and the intersubjective revision of a rule. This paper fills this gap. A conviction is a norm that, according to an individual, ought to be ascribed to a provision. By contrast, a rule is a judicially ascribed norm that controls a case and is protected by the formal principles of competence, certainty, and equality. A revision of a rule is the invalidation or modification such a judicially ascribed norm, provided (...) that the judge meets the burden of argumentation of formal principles. Thus, judges can revise their convictions without changing the law. (shrink)

Alberic of Paris put forward an argument, ‘the most embarrassing of all twelfth-century arguments’ according to Christopher Martin, which shows that the connexive principles contradict some other logical principles that have become deeply entrenched in our most widely accepted logical theories. Building upon some of Everett Nelson’s ideas, we will show that the steps in Alberic of Paris’ argument that should be rejected are precisely the ones that presuppose the validity of schemas that are nowadays taken as some of the (...) most trivial logical truths: (A∧B) → A and (A∧B) → B, i.e. Simplification. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Los cimientos de una sociedad racional en Horkheimer parten de la premisa de hacer de la filosofía social una opción por la Teoría Crítica. Por ello [1] se desarrolla una interpretación dialéctica de lo social entre la filosofía y las teorías de las ciencias sociales, desde la categoría del materialismo interdisciplinario.
